Campa Avvocati, with partner Andrea Santini, found and handled the requests received by a Public Entity from the Regional Public Prosecutor’s Office of the Court of Auditors pursuant to Articles 56 and 58 of Legislative Decree 174/2016. 174/2016. The assistance provided made it necessary to reconstruct the entire affair, dating back in time, through the examination of a large amount of documentation. An analytical and in-depth analysis of the facts led to the reconstruction of what had occurred and to the provision of legal opinions, which allowed the Public Entity to take the correct course of action. In particular, the Public Entity, in accordance with the indications provided, proceeded to reactivate disciplinary proceedings against its employee, the author of the disputed conduct and, at the end of negotiations, to formalise a settlement agreement, which allowed it to define the dispute with its employee. The legal activity carried out also led to an in-depth examination of all the requests received from the Public Prosecutor’s Office of the Court of Auditors, which requested updates in order to verify the correctness of the conduct of the public body and its administrators. The replies prepared, aimed at reporting the determinations made, allowed the matter to be defined poisitively. In fact, a dismissal order was received, which ruled out the existence of any liability profile, since the Entity had acted correctly and prudently, based on the opinions and legal assistance provided.
